'Service of Process' is the legal term for the delivery of documents such as summons, complaints, citations, subpoenas, etc., to individuals, businesses and government entities. Once the documents are delivered to the appropriate person, the person or business is considered to have been 'served'.
In Colorado, each court branch (District, County, Small Clams, & Municipal) has it's own rules as to how service may be made. Rules 4 and 45 in Colorado District Courts would likely be the most well known in legal circles. Rules for lower courts are mostly similar with minor variations. Service of different documents may mean different rules apply. For example, a Colorado District Court Summons may be served not only on the named individual but also on a family member over 18 at the named individual's home, or on that individual's manager at work. A subpoena for that same individual however can only be served on the named individual and no one else. You can always rely on us to know the which rules apply to which circumstance.
People can be served wherever they are found, it's that simple. When serving individuals, our clients generally request we attempt to serve at the home address. Although it should be noted again, individuals can be served wherever they are found.
In the case of corporations, the first place to attempt service should always be the registered agent's office. Information on a company's registered agent can be found on the Secretary of State's website.
Colorado is one of the few remaining states where anyone over the age of 18 can be a Process Server. No licensing or qualification is required. Be forewarned, using an inexperienced Process Server can cost you time and money by making very simple mistakes and it's always advisable to use a professional company such as Hibernia.
Although Covid has changed people's schedules and we are finding more and more individuals at home during the day, we also make attempts to serve individuals at home during evening and weekend hours.
Businesses are served during normal business hours, Monday through Friday.
We will keep you informed as to our progress. When the service has been completed, we will email you a 'proof of service' for you to file with the appropriate clerk of court.
It is incumbent on you to let us know if you need us to serve a witness fee along with your legal documents. Hibernia will provide witness fees up to $100 per your request. Be aware, there is a 10% convenience fee for this service.
